Privacy Policy

This Privacy Policy explains how TOBU E-COMMERCE, LLC, doing business as TOBU LUX Cleaning (“Company,” “we,” “us”), collects, uses, and protects your information when you use our website, book our services, or participate in our rewards program.
1. Information We Collect
- Information you provide: your name, email address, phone number, property address, property details (size, bathrooms), service selections, special instructions, and any messages you send us.
- Access credentials: keys, fobs, gate or garage codes, and alarm codes that you choose to provide so our team can perform the Services.
- Service documentation: time-stamped photographs of the areas we service, taken to record the condition of the property at completion. Our team is instructed to exclude people, personal documents, and other identifying details from these photographs. See Section 6.
- Payment information: card payments are handled by our processor (Stripe). We do not collect or store your full card number on our servers.
- Automatically collected: basic technical data such as device type, browser, and usage information, which may be collected through our hosting and analytics providers.
2. How We Use Your Information
- To provide, schedule, and complete cleaning and related services;
- To process deposits and payments;
- To confirm property details, including verifying square footage against public property records;
- To document completed work and to evaluate any service or damage claim;
- To communicate with you about bookings, service updates, and support;
- To operate our loyalty rewards program;
- To improve our services and website; and
- To comply with legal obligations and enforce our Terms.
3. How We Share Your Information
We do not sell your personal information for money. We share it only with service providers that help us operate, under confidentiality obligations, including: cloud hosting and database services (Google Firebase), payment processing (Stripe), and email, text message/communication providers. We may also disclose information where required by law, to protect our rights, or in connection with a business transfer.
4. Payment Processing
Payments are processed by Stripe, a certified PCI-DSS Level 1 provider. Your card details are transmitted directly to Stripe and are encrypted; they do not pass through or reside on our servers. Stripe’s handling of your data is governed by its own privacy policy.
5. Cookies, Analytics & Advertising
Our website and its providers may use cookies and similar technologies to operate the site and understand usage. You can control cookies through your browser settings; disabling them may affect some functionality.
Our website may also use cookies, pixels, and tags from advertising and measurement providers (such as Google and Meta) so we can measure and improve our marketing. Some privacy laws treat this kind of data sharing as a “sale” or as “sharing” for cross-context behavioral advertising even where no money changes hands. You can limit it through your browser settings, your device’s advertising controls, and the opt-out tools those providers make available, or by contacting us using the details in Section 14.
6. Photographs & Property Documentation
Our team photographs the areas we service to record their condition at the time of completion. These photographs are used only to document our work, to evaluate a service or damage claim, and to train and supervise our team. We do not use them in marketing, on our website, or on social media without your separate written consent. They are stored in access-controlled systems, are available only to personnel who need them, and are deleted after twenty-four (24) months unless they relate to an open claim or dispute. You may ask us to delete photographs of your property at any time using the details in Section 14.
7. Data Retention
We retain your information for as long as needed to provide services, maintain your rewards balance, comply with legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it. As general guidance: booking, service, and payment records are retained for five (5) years, which corresponds to the Florida statute of limitations for written contracts; service photographs are retained for twenty-four (24) months as described in Section 6; and access credentials are deleted or returned at the end of the engagement.
8. Security
We use reasonable administrative and technical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If a security incident affecting your personal information occurs, we will investigate promptly and provide notice to you and to any regulator as required by Florida law, including section 501.171, Florida Statutes.
9. Your Choices & Rights
You may request to access, correct, or delete your personal information, and you may opt out of marketing communications at any time (see Section 10). To make a request, contact us using the details below. We will respond consistent with applicable law.
Florida Digital Bill of Rights. The Florida Digital Bill of Rights applies to businesses that exceed $1 billion in global gross annual revenue, and we are not such a business. We nonetheless honor the access, correction, and deletion requests described above.
10. Marketing & Text Communications
We send promotional text messages only to individuals who have given prior express written consent through a separate, unchecked box on our booking form or website. Consent to receive marketing texts is not a condition of purchase, and you can book and receive Services without agreeing to them. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. We keep a record of the consent you give, including the date, time, and the exact language you agreed to, and we honor opt-out requests promptly.
We send promotional emails only to individuals who have opted in, and you can unsubscribe at any time using the link in any marketing email. Transactional messages about your bookings — confirmations, arrival notices, receipts, and service follow-ups — are not marketing and may still be sent.
11. Children’s Privacy
Our services and website are intended for adults. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
12. Third-Party Links
Our website may link to third-party sites and services (such as Stripe or the TOBU LUX app stores). We are not responsible for the privacy practices of those third parties.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The “Effective Date” above reflects the latest version, and material changes will be posted on this page.

Terms of Service
Effective Date: August 10, 2026
These Terms of Service (“Terms”) govern all cleaning and related services (the “Services”) provided by TOBU E-COMMERCE, LLC, doing business as TOBU LUX Cleaning (“Company,” “we,” “us,” or “our”) to you (“Client,” “you”). By checking the box presented at booking, booking, paying a deposit, or receiving Services, you agree to these Terms and represent that you have read them.
1. Services
The Company provides residential and, where agreed, commercial and short-term-rental cleaning, event cleaning, and staff-training services within Miami-Dade and Broward County, Florida. The specific scope of each engagement is limited to the services selected at booking. Additional work is subject to a separate quote and these Terms.
2. Estimates, Square Footage & Pricing
Prices are quoted based on property size, service frequency, and the details you provide. We reserve the right to confirm a property’s square footage against publicly available Miami-Dade / Broward County property records and to adjust the quote if the information provided is inaccurate. All prices are exclusive of any applicable taxes, which will be added where required by law.
3. Booking, Deposits & Payment
A deposit of 50% of the estimated total is due at the time of booking to reserve your appointment, with the remaining balance due at the time of Service. Deposits are applied to the price of the Service and are refundable only as set forth in Section 4. Payments are processed by our third-party payment processor (Stripe). By booking, you authorize the Company to charge the amounts owed to your selected payment method.
4. Cancellations & Rescheduling
You may reschedule or cancel at no charge by providing at least 48 hours notice before your scheduled appointment. If you cancel or reschedule with less than 48 hours but at least 24 hours notice, the Company will retain 25% of the estimated total and refund the balance of the deposit. If you cancel or reschedule with less than 24 hours notice, or if our team is unable to obtain access to the property at the scheduled time (a lockout), the Company will retain the full deposit.
The parties agree that a reserved appointment cannot reliably be reassigned on short notice; that the Company’s resulting loss — including committed team time, scheduling, and travel — is difficult to determine with precision; that the amounts stated above are a reasonable pre-estimate of that loss; and that they are not a penalty.
5. Client Responsibilities & Access
- Confirm that you are the owner of the property or an authorized agent of the owner, and that you have authority to enter into these Terms on the owner’s behalf and to bind the owner to them.
- Provide safe, timely, and unobstructed access to the property at the scheduled time.
- Ensure running water, electricity, and a reasonable working environment.
- Secure or restrain pets, and disclose any hazards, security systems, or areas that are off-limits.
- Inform us of any surfaces, materials, or items requiring special care or products.
Conditions we may decline. If, on arrival or during the Service, our team encounters conditions that are unsafe or materially outside the agreed scope — including human or animal waste, blood or other bodily fluids, mold, pest infestation, hoarding conditions, post-construction debris, or the absence of running water or electricity — we may decline to begin or may discontinue the Services. In that event the lockout terms of Section 4 apply, and any remediation or additional work is subject to a separate quote.
6. Valuables & High-Value Items
You agree to secure or remove cash, jewelry, watches, firearms, prescription medication, collectibles, important documents, and other irreplaceable or high-value items prior to Service. The Company is not responsible for loss of or damage to such items that are left unsecured, nor for pre-existing damage, wear, or conditions not caused by our Services.
Keys, codes, and alarm credentials. If you provide keys, fobs, garage or gate codes, or alarm credentials, we will store them securely, log their issue and return, and limit access to personnel assigned to your property. We will return or delete them on your request or at the end of the engagement. You agree to notify us promptly of any change to those credentials and to deactivate them once the engagement ends.
7. Damage Claims; Exclusive Remedy
Any claim of damage or loss allegedly caused by the Services must be reported to us in writing within 48 hours of the Service, with reasonable supporting detail and photographs, and before any repair, replacement, or alteration is made, and you agree to give us a reasonable opportunity to inspect the affected item or area first. This notice period is a material condition; claims not timely reported are waived.
We will investigate timely claims in good faith and respond within a reasonable period. Photographs you provide, our time-stamped completion records under Section 8, and any other reasonable evidence may be used to evaluate the claim.
Where a timely claim is verified, the Company’s sole obligation and your exclusive remedy is, at the Company’s option, to (a) re-perform the affected Service, (b) issue a refund, credit, or discount, or (c) submit the claim to the Company’s general liability insurer for handling under the applicable policy. Except for amounts payable to you under that policy, the Company’s liability for any claim of damage or loss shall not exceed the amount you paid for the Service giving rise to the claim.
8. Satisfaction Guarantee
If any area does not meet our standard, you must notify us with photographs within 24 hours of the completion of the Service. Because the condition of a property can change once our team departs, claims reported after this 24-hour window will not be honored. Upon timely notice, we will return to re-clean the affected area at no additional charge. This re-clean is the exclusive remedy under the guarantee and does not entitle you to a refund except at the Company’s discretion.
Our team documents completed work with time-stamped photographs (excluding any personal information or property address) as a record of the condition at the time of completion. These photographs may be used to evaluate any claim under this guarantee or under Section 7, and are handled as described in our Privacy Policy.
9. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” and the Company disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in these Terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law: (a) the Company’s total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the amount you actually paid to the Company for the specific Service giving rise to the claim, except for amounts payable to you under the Company’s general liability insurance; and (b) the Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, loss of use, loss of data, or diminution in value, even if advised of the possibility of such damages. These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). For the avoidance of doubt, the Company’s entire liability for any claim is limited to a refund, credit, or discount not exceeding the amount you paid for the Service giving rise to the claim, together with any amounts payable to you under the Company’s general liability insurance.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or personal injury caused by the Company’s negligence.
11. Indemnification
You agree to indemnify and hold harmless the Company and its owners, employees, and agents from any third-party claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misrepresentation of property details or of your authority to bind the owner of the property, or conditions at the property that you failed to disclose, or any claim brought by an owner, occupant, tenant, guest, or household member of the property arising out of or relating to the Services, except in each case to the extent caused by the Company’s gross negligence or willful misconduct.
12. Non-Solicitation of Personnel
During the engagement and for 12 months afterward, you agree not to directly or indirectly solicit, hire, or engage any Company team member introduced to you through the Services, except through the Company. This clause protects our investment in recruiting and training.
If you hire or engage a Company team member in breach of this Section, you agree to pay the Company a placement fee of $3,500 per team member. The parties agree that the Company’s actual loss in that event — including recruiting, screening, background checking, and training costs, the loss of the team member’s familiarity with the Company’s protocols and clients, and lost productivity during the vacancy — is difficult to determine with precision; that this amount is a reasonable pre-estimate of that loss; and that it is not a penalty. This remedy is in addition to, and not in lieu of, the Company’s right to seek injunctive relief.
13. Third-Party Names & Trademarks
References to Forbes Travel Guide, LQA, AAA Five Diamond, Ecolab, Stripe, Airbnb, or other third-party names describe standards, products, or platforms and do not imply sponsorship, affiliation, or endorsement. All trademarks are the property of their respective owners. The Company is independent and not affiliated with these organizations.
14. Governing Law; Disputes; Class-Action Waiver
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. For any dispute not subject to arbitration under this Section, except for claims that qualify for small claims court, the exclusive venue for any dispute shall be the state or federal courts located in Miami-Dade County, Florida, and the parties consent to personal jurisdiction there. To the extent permitted by law, each party waives any right to a jury trial.
Binding individual arbitration. Except for claims that qualify for small claims court and claims seeking injunctive relief to protect intellectual property or confidential information, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Miami-Dade County, Florida. The Federal Arbitration Act governs the interpretation and enforcement of this provision. The arbitrator shall decide all issues relating to the scope, enforceability, and arbitrability of this provision, except that a court shall decide the enforceability of the class-action waiver below. You may opt out of this arbitration provision by sending written notice to the contact address in Section 20 within 30 days of your first booking; opting out will not affect any other provision of these Terms.
Small-claims option. Either party may bring an individual claim that qualifies in the small claims court for Miami-Dade County, Florida.
Class-action and representative-action waiver. To the maximum extent permitted by law, all disputes must be brought in a party’s individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Each party waives any right to participate in a class or representative action. If this waiver is held unenforceable as to any claim, that claim shall be severed and proceed in court, and the remaining claims shall proceed in arbitration.
Attorneys’ fees. In any action or proceeding to enforce or arising out of these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs, to the extent permitted by law.
15. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your booking governs that engagement, and we maintain a record of the version you agreed to. Material changes will be posted on this page with a new Effective Date and will apply to bookings made after they are posted. Continued use of the Services after changes constitutes acceptance of the revised Terms.
16. Loyalty Rewards Program
The Company may offer a loyalty rewards program (the “Rewards Program”) under which Clients earn points for qualifying purchases. Participation is subject to these Terms and any additional program rules the Company publishes.
- Earning. Points accrue at the rate stated by the Company (currently one point per US$1 spent on completed Services, excluding taxes, fees, and prior discounts). Points accrue on completed Services after your First Visit; the First Visit itself does not earn points. Certain redemptions require ongoing service history as described in the program rules.
- Redemption. Points may be redeemed only for the rewards the Company makes available, in the Company’s sole discretion. Redeeming a reward deducts the corresponding points from your balance.
- No cash value. Points and rewards have no cash value; are not property; and may not be purchased, sold, transferred, assigned, willed, or combined across accounts, and may not be exchanged for cash.
- Expiration. Points expire after twelve (12) consecutive months of account inactivity, or as otherwise stated in the program rules.
- Changes. The Company may modify, suspend, or discontinue the Rewards Program, or change earning rates, reward availability, thresholds, and redemption terms, at any time and, to the extent permitted by law, without notice. We will give notice of changes that materially reduce the value of points you have already earned.
- Forfeiture. Points may be forfeited for fraud, abuse, chargebacks, violation of these Terms, or termination of your account or engagement.
- Taxes. You are responsible for any taxes arising from rewards you receive.
17. Confidentiality
The Company and its personnel will treat non-public information about you, your household, your property, and your affairs (“Confidential Information”) as confidential and will not disclose it except as needed to perform the Services or as required by law. Our team members are bound to these confidentiality obligations, and if you require a separate non-disclosure agreement, we will provide and sign one covering our team and ownership. You likewise agree to keep confidential the Company’s non-public information, including its pricing, methods, and personnel. These obligations do not apply to information that is or becomes public through no fault of the receiving party, was already known, is independently developed, or is lawfully obtained from a third party, or where disclosure is required by law or legal process.
18. Force Majeure
Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including hurricanes and tropical storms, severe weather, flooding, fire, utility failures, loss of building access, labor disruption, public health emergencies, and government orders. We will use reasonable efforts to reschedule affected Services, and a Service canceled for these reasons will not be treated as a cancellation by you under Section 4.
19. Severability; Assignment; Survival & Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and the Company regarding the Services and supersede any prior understandings.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, or sale of all or substantially all of our assets.
No third-party beneficiaries. These Terms create no rights in any person other than you and the Company.
Survival. Sections 6, 7, 9, 10, 11, 12, 13, 14, 17, and 19 survive completion of the Services and any termination of the engagement.
Notices. Notices to the Company must be sent to the contact details in Section 20. Notices to you may be sent to the email address or mobile number you provide at booking.
Headings; interpretation. Headings are for convenience only, do not form part of these Terms, and do not affect their construction. “Including” means including without limitation, and “or” is not exclusive.

- Color contrast chosen for legibility, and respect for reduced-motion preferences.
- Ongoing review as we add or change features.
Known Limitations
We are continually improving. Some third-party components — such as our Stripe payment checkout — are provided by outside vendors, and their accessibility is partly outside our control. If you meet a barrier there, contact us and we will help you complete your request another way.
